Terms and Conditions (T&C)
1. Definitions
- Platform: Refers to the Dreambooth SaaS photobooth platform.
- Provider: PT Mimpi Teknologi Nusantara, the company that owns and operates the Platform, with its registered office at Jl. Tutul No. 8, Papringan, RT 012 / RW 004, Caturtunggal, Depok, Kab. Sleman, Daerah Istimewa Yogyakarta (NPWP 1000 0000 0854 2873).
- Client: The individual or organization subscribing to and using the Platform services.
- End-User: The end consumer interacting with the photobooth application.
- Content: Includes frames, templates, and any other media uploaded or designed by the Client.
2. Acceptance of Terms
By subscribing to the Platform, the Client agrees to abide by these Terms and Conditions.
3. Service Usage
- The Platform grants the Client a non-exclusive, non-transferable license to use the service during the subscription period.
- Clients must ensure their Content adheres to applicable laws and regulations.
- The Client is responsible for all activities conducted through their account, including actions by their employees or contractors.
- The Platform retains the right to monitor and remove Content flagged as violating laws or third-party rights.
4. Content and Copyright
- The Client retains ownership of the Content they upload or create using the Platform.
- The Client is solely responsible for ensuring that any Content, including frames or designs, does not infringe on copyrights, trademarks, or other intellectual property rights.
- If a law dispute arises due to copyrighted Content uploaded by the Client, the Platform is not liable. The Client assumes full legal responsibility.
- Frames or templates uploaded as public may be shared across the Platform unless explicitly marked as private by the Client.
5. Prohibited Activities
Clients are prohibited from:
- Using the Platform for unlawful or fraudulent activities.
- Reverse-engineering or attempting to replicate Platform functionality.
- Uploading Content that is harmful, offensive, or violates third-party rights.
6. Subscription and Payment
- Subscriptions can be purchased for one or more devices and for durations of 1, 3, 6, or 12 months (30 days per month). Specific subscription and activation rules, including the 30-day activation window for new purchases, are set out in the Subscription and SLA document.
- Subscriptions are billed according to the selected duration and device count.
- Failure to pay the subscription fees may result in service suspension or termination.
- Refund policies will adhere to applicable consumer protection laws in Indonesia.
- The details of features for each subscription plan may change with prior notice, but the Client's subscription tier and expiration date will remain unchanged.
- The Platform may adjust subscription prices with prior notice; however, such changes will not affect active subscriptions purchased by Clients.
7. Platform Wallet and Withdrawals (Trial Facility)
- The Platform Wallet (the "Dreambooth Wallet") is an optional trial facility offered to help new Clients who do not yet have their own payment gateway begin accepting payments. It is not intended as permanent payout infrastructure; Clients are encouraged to connect and use their own payment gateway (e.g. Midtrans) once their business is established.
- Funds in the Platform Wallet are processed through the Provider's own Midtrans merchant account. By using the Platform Wallet, the Client acknowledges that their earnings and withdrawals are subject to the same risks, limits, reviews, and processing conditions that apply to that merchant account.
- These risks include, without limitation, delayed, held, suspended, or rejected disbursements arising from payment-provider (e.g. Midtrans) or banking risk assessments, compliance reviews, or regulatory action — including circumstances caused by the activity of other Clients sharing the same merchant account. The Provider does not guarantee withdrawal availability or timing for the Platform Wallet.
- The Provider will notify affected Clients of any material withdrawal disruption and will use reasonable efforts to resolve it, but is not liable for losses arising from such delays or holds (see Limitation of Liability).
- Withdrawals from the Platform Wallet are subject to a minimum amount, applicable fees, identity verification (MFA), bank-account validation, and cooldown periods as shown in the withdrawal flow and the product documentation.
- Clients who connect their own payment gateway receive funds directly through their own account and are not exposed to the shared-risk conditions of the Platform Wallet.
8. Limitation of Liability
- The Platform is provided "as is" without warranties of any kind, express or implied.
- The Platform shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the service.
9. Termination
- The Platform reserves the right to terminate a Client's access if these Terms are violated.
- Clients may terminate their subscription by providing a written notice.
10. Changes to Terms
The Platform reserves the right to modify these Terms at any time with prior notice to Clients.
11. Governing Law
These Terms are governed by the laws of Indonesia.
12. Data Use and Improvement
- The Platform may use anonymized and aggregated user and client-generated data to enhance business operations, improve customer experience, and develop new features in compliance with applicable laws and privacy standards.
- The Platform commits to safeguarding the privacy and confidentiality of data in accordance with its Privacy Policy.
